Acceptance of these terms
These terms govern the use of the OsceMedics website and any account created on it. Opening the website, reading its pages or submitting a form is taken as agreement to everything set out below.
If any part of this document is unacceptable to you, the right course is to stop using the website rather than continue on different assumptions. Continued use after an update takes effect counts as acceptance of the version then published.
What this website is
OsceMedics publishes plain language explanations of Medicare coverage choices and offers a place to keep personal notes while a decision is being worked through. Everything published here is general information about how coverage is structured and what the options ask of a person.
Nothing on this website is medical advice, legal advice, tax advice or a recommendation that a particular plan is right for a particular person. Coverage rules vary by state, by insurer and by individual circumstance, and the official plan documents always take precedence over anything described here.
No connection to a government agency
OsceMedics is an independent website. It is not the Medicare program, not the Social Security Administration, not the Centers for Medicare and Medicaid Services, and not any other federal or state agency, nor is it endorsed by one.
Enrollment in any part of Medicare happens through the official channels operated by those agencies or through a licensed insurer. This website does not process enrollments, submit applications, issue coverage or bind any insurer to anything.
Who may use the website
Use of this website and creation of an account are limited to people who are at least 18 years of age and resident in the United States. By creating an account you confirm that both statements are true of you.
Accounts may not be created on behalf of another person without that person's knowledge and permission, and information submitted about somebody else is treated as though the account holder had permission to submit it.
Accounts and passwords
An account holder chooses the password and is responsible for keeping it private. Anything done through an account is treated as having been done by the person who holds it.
Certain obligations sit with the account holder rather than with OsceMedics:
- Keeping the login details out of the hands of other people.
- Reporting any suspected unauthorized access as soon as it is noticed.
- Keeping the contact details on the account accurate, so replies reach the right place.
- Making sure the information saved to the account is correct, since answers are written against it.
An account may be suspended or closed where these terms are broken, where the information supplied is knowingly false, or where continued access would create a risk for other users of the website.
Acceptable use
The website is provided for personal use. The following are not permitted under any circumstance:
- Copying, scraping, republishing or reselling material from this website.
- Attempting to reach parts of the website or another person's account without authorization.
- Uploading anything designed to damage, disable or interfere with the website or its users.
- Using the contact forms to send unsolicited advertising or bulk messages.
- Presenting any part of this website as the work of somebody else or as official government material.
Access may be withdrawn without notice where any of the above occurs.
Messages and telephone contact
Where the consent boxes on the signup form are selected, OsceMedics may send text messages of the kind described beside each box. Message frequency varies with what is happening on an account, and standard message and data rates from the recipient's carrier may apply.
Consent to marketing messages is never a condition of using this website or of receiving an answer to a question. Replying STOP to any message ends further messages of that type, and replying HELP returns support information. Service messages that relate directly to a submitted request may continue where they are needed to answer it.
Information submitted by users
Information supplied through a form or saved to an account is used to answer the question that was asked and to keep the account usable. It is handled in the way set out in the Privacy Policy, which forms part of these terms.
Submitting information that is inaccurate or incomplete affects the usefulness of any answer written against it, and OsceMedics accepts no responsibility for a conclusion drawn from details that were wrong when they were supplied.
Plans, insurers and outside websites
Plan names, insurer names and any figures printed in a plan document belong to the companies and agencies that publish them. Where this website points to an outside page, that page is under somebody else's control and its content is not the responsibility of OsceMedics.
Before acting on anything, confirm it against the official plan documents, the insurer or the relevant government agency. Those sources are authoritative and this website is not.
Material published on this website
The text, layout, images, structure and code of this website belong to OsceMedics except where they are credited to somebody else. Personal reading and printing for personal reference are fine.
Republishing, redistributing or building a competing service from this material requires written permission in advance. The brand name and the logo may not be used in a way that suggests an association that does not exist.
Availability and accuracy
The website is offered as it stands. There is no promise that it will be available without interruption, that every page will be free of error, or that the information on it reflects the most recent change published by an insurer or an agency.
Coverage rules and plan details change on their own schedule. Anything read here should be treated as a starting point for a conversation, not as a settled statement of what a particular plan will do in a particular year.
Limits on liability
To the fullest extent the law allows, OsceMedics is not liable for indirect, incidental, special or consequential loss arising from use of this website, including a coverage decision made after reading it.
Where liability cannot be excluded, it is limited to the amount paid for access to this website, which for ordinary use of these pages is nothing.
Responsibility for misuse
Anyone who uses this website in breach of these terms, or in a way that breaks the law, agrees to cover the costs and claims that follow from that use, including reasonable legal fees.
This obligation survives the closure of an account.
Updates to this document
These terms may be revised as the website changes or as the rules that apply to it change. The revised version is published on this page with a new date at the top, and it applies from the moment it appears.
Reading this page again from time to time is the reliable way to stay current, since individual notice of a change is not sent.
Governing law
These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute that cannot be settled directly is subject to the courts sitting in that state.
If any provision here is found unenforceable, the rest continues in force and the unenforceable provision is read as narrowly as needed to make it valid.
